Perversion of Justice?

A man accused of using a camera to take pictures under the skirt of an unsuspecting 16-year-old girl at a Tulsa store did not commit a crime, a state appeals court has ruled.

The state Court of Criminal Appeals voted 4-1 in favor of Riccardo Gino Ferrante, who was arrested in 2006 for situating a camera underneath the girl's skirt at a Target store and taking photographs.

Ferrante, now 34, was charged under a "Peeping Tom" statute that requires the victim to be "in a place where there is a right to a reasonable expectation of privacy." Testimony indicated he followed the girl, knelt down behind her and placed the camera under her skirt.

In January 2007, Tulsa County District Judge Tom Gillert ordered Ferrante's felony charge dismissed. That was based upon a determination that "the person photographed was not in a place where she had a reasonable expectation of privacy," according to the appellate ruling issued last week.

The District Attorney's Office had appealed Gillert's ruling to the Court of Criminal Appeals.
So, perverts in Oklahoma would have the right to take up-skirts in public places like malls and stores and these women and girls would have no recourse?

The story makes it appear as though the problem is the construction of the statute, in that it hasn't caught up with the technology, but I wonder if they had cameras when the original statute was enacted in 1959 or when it was amended in 2001.

The statute at question is 21 OC 1171:
A. Every person who hides, waits or otherwise loiters in the vicinity of any private dwelling house, apartment building, any other place of residence, or in the vicinity of any locker room, dressing room, restroom or any other place where a person has a right to a reasonable expectation of privacy, with the unlawful and willful intent to watch, gaze, or look upon any person in a clandestine manner, shall, upon conviction, be guilty of a misdemeanor. The violator shall be punished by imprisonment in the county jail for a term of not more than one (1) year, or by a fine not to exceed Five thousand Dollars ($5,000.00), or by both such fine and imprisonment.

B. Every person who uses photographic, electronic or video equipment in a clandestine manner for any illegal, illegitimate, prurient, lewd or lascivious purpose with the unlawful and willful intent to view, watch, gaze or look upon any person without the knowledge and consent of such person when the person viewed is in a place where there is a right to a reasonable expectation of privacy, or who publishes or distributes any image obtained from such act, shall, upon conviction, be guilty of a felony. The violator shall be punished by imprisonment in the State Penitentiary for a term of not more than five (5) years, or by a fine not exceeding Five Thousand Dollars ($5,000.00), or by both such fine and imprisonment.

The Oklahoma Legislature has some work ahead of it to fix the defects in the statute.

Ferrante's attorney, Kevin Adams, said Tuesday that Gillert "made the right decision" and that "it is really up to the Legislature to make this against the law if they want to do so.

"I think it is a scenario where the law has not caught up with technology," Adams said.
The pervert's lawyer thinks the law hasn't caught up with the technology (which as noted, had been revised as recently as 2001). I say the pervert hasn't caught up with a size 10 boot for preying on 16-year olds. What gives him the right to do so? His lawyers got him off on a technicality because the Court and the prosecutors didn't apply common sense here.

Closing Yankee Stadium With A Hockey Game?

If reports are accurate, that's exactly what will happen. The NHL, Yankees, and the City of New York are in talks to have Yankee Stadium host an NHL game between the New York Rangers and the Detroit Red Wings.
Now, whispers are getting louder that historic Yankee Stadium will host a rare outdoor National Hockey League game in late 2008 or early 2009 featuring the Rangers and the Detroit Red Wings.

Several news outlets are reporting today that a deal is in the works that would close the 85-year-old cathedral with skates instead of spikes.

"It's something we've spoken both to the Yankees and to the city about," NHL deputy commissioner Bill Daly told the New York Daily News. "But it's not a done deal. There are still other possibilities and a lot of moving pieces."

But Chris Chelios, a Detroit Red Wings defenseman, told the Detroit Free Press that he understands the Red Wings will visit the Rangers for the Yankee Stadium closer and that it is a "done deal."

"I heard it's a done deal already, I heard Detroit is playing that game, the last event actually in Yankee Stadium," Chelios said."Not just because of the history of Yankee Stadium, but to be able to be a part of the last event ever to be played is going to be something special."
It would definitely be quite the event, but it should close with a baseball game - it only seems fitting.

Clipped?

Has a fifth undersea Internet cable been clipped? That's what this latest report suggests (HT: The Jawa Report). Something strange is definitely afoot. I'm sure the conspiracy theorists are hard at work trying to figure out what is going on. Some are suggesting the US Navy's latest spy sub, the USS Jimmy Carter might be behind these incidents, while others are pointing fingers at Israel (how original).

Could it be as simple as structurally deficient or flawed cables? Or is there a more sinister explanation? No one really knows, or if they do, they're not saying.

In any event, this is doing a real number on Internet communications throughout the Middle East and South Asia.

No Higher Priority?

What does Senator Arlen Specter (R-PA) think is an important use of Congressional time, energy, and money? Is it to confirm judges? Is it to pare down a budget and exercise fiscal restraint?

No.

It's to use Congress' time and powers to investigate the NFL's conduct of how the league investigated the New England Patriots videotaping of opponents (ht: Althouse).

Is there nothing more important on the world agenda to spend time on a game?

What a farce.

This really tells me that Congress has way too much time on their hands and people like Specter ought to be retired from Congress so they can really concentrate on what's really important for the nation's future.

Pooped Out

After a broken pipeline cut off water to sinks and toilets at the state's Harriman Office Campus, Labor Department employees were alternately fuming and laughing at a short-lived plan to bus them to Crossgates Mall if they needed a bathroom break.

"They were telling us to take a bus to the bathroom," marveled Debbie Atwell, one of approximately 1,300 Labor Department employees who, after a restroom-free morning, were sent home at 12:30 Thursday afternoon.

The water crisis actually started shortly after 7 a.m., when early arrivals at the sprawling office campus realized the water main that feeds the campus had burst.

Soon after that, employees in buildings 8, 8a, and 4, which house the Department of Taxation and Finance and the Division of Military and Naval Affairs, were sent home.

But the massive Building 12 initially was hit with just lower water pressure, and repair workers thought they had the problem licked.

"We had the water restored at about 9:45," said Department of Labor spokesman Leo Rosales. "There was a rush to the bathroom that impacted the system," he added.

Others put it more graphically, noting some toilets either stopped working or started to back up.

So supervisors put out word that vans would ferry people the approximately two miles to Crossgates as well as other shopping spots and businesses for potty breaks.

No one actually used the toilet shuttle, however, although one van was about to leave when word came that Building 12 was also closing for the day at about 12:30 p.m. Buildings 7 and 22 had lower water pressure but didn't have to close.

Unionized employees of the Labor Department -- which among other functions ensures safe and sanitary workplaces for New Yorkers -- were not amused at the shuttle idea or that workers couldn't safely relieve themselves in-house.

"A number of the bathrooms overflowed," said Gary China, a representative of the Civil Service Employees Association (CSEA), which represents about 800 Building 12 workers.

China and another rep, Angelique Bywater, were dispatched by the union to see what was going on. Bywater questioned the wisdom of trying to send people to places like shopping malls or the nearby SEFCU credit union, which was identified as another possible backup bathroom.

"How was everybody going to walk into SEFCU's bathroom?" she asked.

Betty McLaughlin, vice president of CSEA's Local 67O, said she wonders if the problem wouldn't have been resolved sooner if the new Labor commissioner, M. Patricia Smith, spent more time in the building rather than in New York City.

This Research Gig Too Good To Pass Up

A German research published in New England Journal of Medicine and Weekly World News said that men staring at women's breasts in fact prolong their lives with years.

"Just 10 minutes of staring at the charms of a well-endowed female such as Baywatch actress Pamela Lee is equivalent to a 30-minute aerobics work-out," said author Dr. Karen Weatherby, a gerontologist.

The team led by Weatherby was made up of researchers at three hospitals in Frankfurt, Germany, and found this results after monitoring for 5 years the health of 200 male subjects, half of whom were asked to look at busty females daily, while the other half had to abstain from doing so.

For five years, the boob oglers presented a lower blood pressure, slower resting pulse rates and decreased risk of coronary artery disease.
What does a guy have to do to get a job as a researcher these days? And how exactly did they manage to convince the research advisory committees that this was research worth funding? Well, when you show boobs, anything goes.

So, if we've got to see boobies for 10 minutes a day to gain a benefit, here's my response:

Bridezilla Strikes In Iraq


There are bridezillas and then there are bridezillas.

This guy is truly a bridezilla. He and his "groom" were both picked up by Iraqi authorities when their "wedding convoy" got stopped at a checkpoint.
Upon inspecting the convoy, soldiers found a stubbly-faced man, Haider al-Bahadli, decked out in a white bride's dress and veil.

Bahadli was wanted on terror-related charges, as was his groom, Abbas al-Dobbi, the official said.
Both are wanted insurgents. Two others were detained as well.

No doubt the "bride" will be getting all manner of wedding gifts in the coming days.

Did he choose to be the bride or did he pull the shortest straw?

What kind of message is being sent with this game? Avoid being caught by the border police for as long as possible and points are awarded not only for the time evading the border police, but when you get the border police to crash into each other.

Serendipity

Serendipity, the ice cream joint made famous by its frozen hot chocolates, a movie by the same name, and $25,000 sundaes, has been closed by the Department of Health for failing inspection for the second time in a month.
The Health Department confirmed Thursday to CBS 2 that the shop had been shut down Wednesday night after failing its second straight inspection in just a month's time.

Department officials tell CBS 2 that both inspections revealed "rodent and fly infestation and conditions conducive to pest infestation, including stagnant water in the basement."

The plumbing was reportedly so out of line that the "sewage disposal system [was] in disrepair or not functioning properly."

On Wednesday night, the store apparently kept open its wild zoo of filth for inspectors. The Department says the inspector came upon a live mouse, more than 100 live cockroaches, fruit flies, house flies, and piles of mouse dropping scattered about the restaurant.

Just last week, owner Stephen Bruce introduced the world to his slightly overpriced chocolate sundae. For $25,000, a customer could purchase the "Frrozen Haute Chocolate," a blend of 28 cocoas, including 14 of the most expensive and exotic from around the world, served in a golden-lined goblet with a gold and diamond bracelet wrapped around its base.
Apparently they didn't have the money to spend on fixing broken and inoperative plumbing and eliminating a rodent and vermin infestation.

Ouch.

Insane Palestinian Rumor Mongering of the Day

Now, it's female Israeli soldiers peeling off their clothes to entice Palestinian boys to stop their rock throwing and attacks against Israeli forces, only to be killed when the female Israeli soldiers bust out their handguns from their undies.

I kid you not.
The Palestinian Authority newspaper Al-Hayat Al-Jadida carried a story this week about IDF tactics that surpassed all previous accusations of supposed Israeli deviousness - poisoned candies, hormone-laced gum, poisoned wells, magnetized belts - in its bizarreness.

According to an Al-Hayat Al-Jadida front page report, the IDF has turned to using armed, female strippers in its war on upstanding Palestinian boys. The newspaper reports that when the Arab rock-throwing begins, IDF soldiers run for cover. Then, the story continues, after some time of hiding, an Israeli woman stands up on top of a barricade and begins to perform an alluring strip tease. Innocent Arab teenage boys, distracted from the business of rioting, are enticed to approach, when, according to the newspaper, the woman ? an IDF soldier ? shoots them with a pistol she had hidden in her underwear.
There is, however, this story, which lends credence to the possibility that Israeli women, particularly Israeli soldiers, have certain charms that even the Israeli military can't completely master.

Woe be to those that stand in the way of the power of Israeli women. You can't stop them; you can only hope to contain them.

Tampa Grand Jury Requests DNA From Goose Creek Suspect

A federal grand jury in Tampa is asking for DNA and hair samples from a University of South Florida student jailed four weeks ago in South Carolina on explosives charges, his attorney said.

Andrew Savage said in a phone interview Wednesday night that he had no indication why the samples were being sought from his client, Youssef Megahed.

The news comes as the grand jury heard testimony Wednesday from people who have connections to Megahed and to another USF student arrested at the same time, Ahmed Mohamed.

Accompanied by attorneys, at least three people entered the grand jury area of the U.S. District Courthouse on North Florida Avenue in downtown Tampa. They were the owner of a home where Mohamed planned to rent a room, the landlord's son, and a Muslim community spokesman. All three later declined comment to a reporter.

Megahed and Mohamed, were pulled over for speeding Aug. 4 about seven miles from the Goose Creek Naval Weapons Station, which houses a military prison for enemy combatants.

The men were charged with possession of an incendiary or explosive device, based in part on items found in the trunk of their car. Mohamed said they were carrying fireworks.

One week later, Aug. 11, the FBI searched a home at 12402 Pampas Place in Tampa, owned by Noor and Ana Salhab. Authorities said the search was related to the case involving the two students.
Questions abound over what exactly Megahed and Mohamed were doing near the Goose Creek NWS with the devices in their possession.

So, what exactly does CAIR have to do with all this? Well, this for starters:
Also appearing before the grand jury Wednesday was Ahmed Bedier, who has been a spokesman for the Megahed family. Bedier is executive director of the Tampa chapter of the Council on American Islamic Relations and a frequent media spokesman for Muslims and Islamic causes. He was accompanied by attorney Lyann Goudie and appeared to be in the grand jury area for about an hour. Bedier declined to answer questions about his testimony, saying he wanted to check with the national headquarters of CAIR about what he was allowed to say. Bedier has called for fairness in the investigation of the students. He has stopped short of vouching for them.”

Brilliant!

The researchers who managed to get grants to study this are simply brilliant. They had to come up with a research plan that would enable them to study the female form in all its glory to determine who had the sexiest strut. That would mean poring over tons of video - in slow motion no doubt - to determine the winner.

They've scientifically deduced that Jessica Alba is the winner, beating out Marilyn Monroe by a smidge.

Perusing the Docket

Crazy lawsuits spring up from creative lawyers hoping to enrich themselves and their clients, along with the occasional nutcase hoping to make waves. Most of these suits never go anywhere, but some are entertaining just for who are named as parties to the suit.

Jonathan Lee Riches is someone who has way too much time on his hands. Being a convict in prison could explain that.

He's currently got a lawsuit pending for $65,000,000,000 billion against Michael Vick, claiming that he stole Riches' dogs and used the proceeds to buy missiles from Iran:
Embattled NFL quarterback Michael Vick, facing federal charges related to his alleged participation in dogfighting, has been hit with a "$63,000,000,000 billion dollar" lawsuit filed by a South Carolina inmate who alleges the Atlanta Falcons star stole his pit bulls and sold them on eBay to buy "missiles from Iran," FOX News has learned.
Anonymous emailer points out another suit brought by Riches on a federal civil rights claim on behalf of himself and other prisoners. This suit lists hundreds of defendants including (and my comments in parens): Plato (he's dead Jim!), Paris Hilton (understandable), Geico (I guess he doesn't like cavemen much), President Bush (gotcha), Boris Becker (I'm more a Sampras guy myself), Jewish Mossad (shhh! they really do run everything), Rastafarian Natives (Bob Marley was unavailable for comment), Geneva Convention (gag rule in effect), Sammy Sosa (but he loves baseball!), Ben Gurion Airport (is there anything an airport can't be blamed for?), the Uniform Commercial Code (damn the Code, full speed ahead!), James Hoffa (who I presume is not buried under Giants Stadium for purposes of this suit), Jerry West (okay, I concede this one if you're a Celtics fan), John Deere (what, he doesn't like tractors?), the Queen of England (I'd sue too if I had heirs like Prince Charles), Three Mile Island (that's the nuclear plant folks), etc.

This goes on for 57 pages.

Riches is forcing courts to waste valuable time and effort on dispensing with these bogus claims. While frivolous lawsuits are no laughing matter when you've got a backlog of cases in many parts of the country, he should submit his stuff to the late night talk shows - they could use the material for jokes and bits.

Three Men Detained After Being Pulled From Submersible In East River

Authorities are questioning three men after pulling them from a submersible vessel in the East River in Brooklyn, N.Y., according to reports from ABC affiliate WABC.

The men were captured near the Brooklyn Cruise Terminal in downtown Brooklyn, near the massive cruise ship the Queen Mary 2, just after 11 a.m.

The intent of the three men being held by police remains unclear, but the initial indication is that it did not appear to be terror-related. They have not been identified by police and no charges have been filed.

The orblike vessel, with a circular hatch on the top for entering and exiting, remains moored in the East River in the Red Hook section of Brooklyn. It was equipped with oxygen tanks, WABC reported.
This is certainly suspicious as one doesn't see a submersible entering New York harbor every day, let alone one that was discovered near the Queen Mary 2 in Brooklyn's Red Hook.

I'd suggest this is a developing story. One has to wonder what kind of story the three men are telling authorities at this point, even as the authorities are saying that it didn't appear terror related. Perhaps on a cursory examination there was no sign of explosives, but a submersible in the busy New York harbor could cause damage to ships passing over it, including death or injury to the three occupants.

The captain of the vessel was issued a violation by the Coast Guard for operating within a security zone and operating an unsafe vessel.

All in all, this is quite curious.

UPDATE:
When in doubt, go to the submariners to get their take. Bubbleheads is left scratching his head over this one. On the one hand, it has the makings of an almost dry run, but on the other - what the heck were they thinking? What were they thinking pervades Rotini's sub BBS. The tricky currents in NY harbor are dangerous enough for surface craft - recall the crash of the Staten Island Ferry a few years back - let alone a submarine of the kind discovered today.

Missile Launcher Discovered On Jersey City Lawn?

image via WCBSTV.com Imagine my surprise if I were to discover a rocket launcher on my front lawn. Well, that's exactly what happened to a woman in Jersey City. She found an item that she initially believed to be a pipe on her lawn. However, on closer inspection, it was a missile launcher.

She called police, who are now investigating the matter.
A Jersey City woman made a shocking discovery on her lawn this morning when she noticed a military rocket launcher lying in the grass.

Niranjana Besai was leaving her house, located at 88 Nelson Street, to go to work just after 8 this morning when she spotted the launcher on her front lawn. "I read it and it [said] 'missile,'" Besai told CBS 2 HD. "There was little 'missile' [writing] on it."

She immediately called police.

Sources tell CBS 2 HD that the device is an AT-4 missile launcher that is used to fire against tanks and buildings. The device was first approved by the U.S. Army in 1985 and questions are being raised as to whether the device was stolen from a branch of the military.

What's more troubling, sources add, is that Besai's house is located along flight path for Newark Liberty International Airport.
Jersey City police were not saying whether the device was operative or not. If the device is indeed an AT-4 launcher, here's what one would look like and the specs.

UPDATE:
There are several weapons that are called AT-4. The weapon above is an antitank weapon of Soviet origin. This is an American weapon that is also designated an AT-4, and appears to be more in line with what is being described. The other weapon system is larger, heavier, and is more often mounted on a vehicle.

UPDATE:
Feds report that the launcher was harmless as it was empty. Still, there are questions to be asked as to how it arrived on this person's front lawn.
An empty military rocket launcher found on the front lawn of a Jersey City residence today caused a brief scare today, before federal authorities determined the device was inoperable and harmless.

U.S. Army ordinance experts are now trying to track down the serial numbers on the device to determine its origin.

According to the FBI, the launcher was the empty holder for an AT-4 anti-tank weapon - a one-shot rocket-propelled projectile used by the infantry to destroy or disable armored vehicles. The launcher is discarded after use.
UPDATE:
I deleted the image of the Soviet-make AT-4 as that is not the weapon involved here. Also, it appears that one could potentially purchase the AT-4 casing online for $250 (HT: easy at LGF).

Apparently, we're not going to the right golf courses around these parts as the golf course in question had stripper stations set up to help golfers get in the swing of things for what was being billed as a private party. World Hot Dog-Eating Champion Crippled by Jaw Injury

TOKYO — A Japanese man who set a world record by wolfing down dozens of hot dogs within minutes has suffered a severe jaw injury due to his rigorous training, making his next title uncertain.

Takeru "Tsunami'' Kobayashi said he can only open his mouth to make a gap the size of a fingertip after being diagnosed with jaw arthritis.

In an entry on his blog entitled "Occupational hazard,'' Kobayashi said: "My jaw refused to fight any more.''

The injury occurred only a week after the slender 29-year-old started training to win his seventh straight title at the annual July 4 Nathan's Famous hot dog eating event at New York's Coney Island.

"I feel ashamed that I couldn't notice the alarm bells set off by my own body,'' he said.

"But with the goal to win another title with a new record, I couldn't stop my training so close to the competition.

"I was continuing my training and bearing with the pain but finally I destroyed my jaw."


The Nathans annual Hot Dog Eating Competition is a great New York tradition. Recently, it has been carried live on ESPN with several hours of build up to the event, including replaying of previous events and other competitions (reminiscent of Super Bowl day coverage.) Lawhawk, Mrs. Lawhawk, Mrs. Legalbgl and myself watched the event together for the last couple of years.

Will Kobayashi's injury be the opening that Joey Chestnut needs to overcome his second place performance last year ? He is the current American record holder now with 52 hot dogs and buns in 12 minutes. Or could this be the year that Sonia "The Black Widow" Thomas, last years third place finisher, takes the prize? My money is on train conductor Eric "Badlands" Booker, who holds records in matzoh balls and pies to take the top prize!

Bottom Story of the Day

John Ramsay and Beth Holloway Twitty are dating. (HT: Anonymous emailer) If those names sound familiar, that's because John's daughter Jon Benet was found murdered in his home in December 1996. Beth Holloway's daughter, Natalee, was reported missing in Aruba in 2005 and presumed murdered.

No one has ever been charged with the murder in connection with either case.
John Ramsey, 63, and Beth Holloway Twitty, 46, have been romantically involved since January 2007, though the two met at a fundraiser last summer.

The couple has been spotted openly holding hands and kissing in Mountain Brook, Ala. — where Twitty lives — and at an art show at a nearby art museum. They've also been seen at various restaurants.

Ramsey's wife and JonBenet's mother, Patsy Ramsey, died last June of ovarian cancer at the age of 49. Twitty was officially divorced from George "Jug" Twitty in December.

Both single parents share the tragedy of children who are victims of unsolved crimes.

Nessie Found?

Has the long sought after Loch Ness Monster finally been videotaped? CNN reports that a team claims to have done just that.
Like tartan, bagpipes, and shortbread Scotland's Loch Ness Monster is as much an emblem as a tourist draw.

And now Nessie's back.

An amateur scientist has captured what Loch Ness Monster watchers say is among the finest footage ever taken of the elusive mythical creature reputed to swim beneath the waters of Scotland's most mysterious lake.

"I couldn't believe my eyes when I saw this jet black thing, about 45-feet (15 meters) long, moving fairly fast in the water," said Gordon Holmes, the 55-year-old a lab technician from Shipley, Yorkshire, who took the video this past Saturday.

He said it moved at about 6 mph (10 kph) and kept a fairly straight course.

"My initial thought is it could be a very big eel, they have serpent-like features and they may explain all the sightings in Loch Ness over the years."

Loch Ness is surrounded by myth and mystery, as it is the largest and deepest inland expanse of water in Britain. About 750 feet (230 meters) to the bottom, it's even deeper than the North Sea.

Nessie watcher and marine biologist Adrian Shine of the Loch Ness 2000 center in Drumnadrochit, on the shores of the lake, viewed the video and hopes to properly analyze it in the coming months.

"I see myself as a skeptical interpreter of what happens in the loch, but I do keep an open mind about these things and there is no doubt this is some of the best footage I have seen," Shine said.
I think this is the tape they claims shows a creature gliding under the waves and breaking the surface at several points:



Hey, it wouldn't be the first time that scientists have found previously unknown species before.

The Liveleak video purporting to show Nessie is not the same footage that appears at the CNN website. I'd look again at the CNN article and see if the footage purports to show what they claim.
