Former Staten Island Congressman Vito Fossella pleaded guilty in Virginia this morning to DUI.
During an appearance in an Alexandria courtroom, Fossella was expected to appeal his December conviction of a misdemeanor drunken-driving charge.
By state law, such an appeal triggers an automatic retrial before a jury, a proceeding set to start today.
Instead, Fossella, 44, pleaded guilty and will serve a five-day sentence that was originally imposed on him following last year's bench trial.

Ex-Rep. Vito Fossella Gets 5 Days In Jail On DUI Rap
The former darling of the GOP, Rep. Vito Fossella instead turned out to be living a double life when he was arrested for driving under the influence. He's going to spend five days in jail.
