As Stop the ACLU and Blue Crab Boulevard note, Sen. Chuck Schumer has said that he would veto any judicial nominees of the Alito mold. That came as President Bush signalled that he would renominate many of the same nominees that were eseentially sidelined by the Democrats. Tim at Balloon Juice notes that Bush is determined to wring a few more nominations out of the lame duck session, but even GOPers have their doubts.
This sets up quite the delicious test of wills. The gang of 14 will be a distant memory in just a few short months. GOPers are going to be the minority in the new session, and they didn't particularly act like the majority when they were in control. Will they resort to the same parlimentary procedures Democrats utilized to massage the flow of debate on judicial nominees? Will they cave and further anger the conservative base that raised such a ruckus when Bush first nominated Miers. Will they split the difference and get some nominees appointed while others are turned away.
