Harriet E. Miers, the White House counsel, as his choice to replace Justice Sandra Day O'Connor this morning, his second nominee for the Supreme Court.Considering that she has no published legal opinions, I'm not sure how people will judge this nominee on the merits. She's got the appearance of a stealth candidate and that isn't going to please very many people on the Left or Right.
Was there no one better among both the male and female candidates for this position? I get the feeling that this was not a particularly good pick to either placate the Right flank within the Bush Administration or show that Bush would pick the very best candidate regardless of all other factors.
One area of concern I have is that since she was White House Counsel, questions arising out of the prosecution of the war on terror and other US Government policies may require her to recuse herself from those cases. Why should we be put in that kind of position.
That said, I figure that unless there's some skeleton in her closet, she'll be confirmed, with a 75-25 margin.
Others blogging the story include Instapundit who is underwhelmed, Michelle Malkin who is utterly underwhelmed, Powerline's John Hindraker is disappointed, Polipundit isn't thrilled with the pick but can live with it, and the list goes on.
UPDATE:
Mary Katherine Ham guest blogging at Wizbang! is not thrilled. Underwhelmed appears to be the comment of the day.
What was the President thinking in making this selection? Why did they think that this was the best person for the job and his comments thus far are not particularly convincing.
UPDATE:
Is this nomination in trouble? That certainly seems to be the grave and gathering tone from the right side of the blogosphere. Why did President Bush go this route? Because he could is a plausible reason, but does nothing to advance his position politically, socially, or culturally.
Technorati: Harriet Mier, Harriet Miers, SCOTUS, President Bush
